SCOTUS Justice Alito on the hot seat .
Associate Justice Sam Alito is now in the crosshairs . In a pretty transparent ploy to get him to recuse himself from the Trump immunity case;the Dems have concocted an ethics attack on Alito.

After Jan 6 the American flag was flown upside down at his home , according to the NY Slimes . They interviewed his neighbors to confirm that .

Is there something illegal in doing so ? No The Slimes contends it was a symbol used by Trump supporters to protest the 2020 election results . The flag was flown at the time that SCOTUS was considering a challenge to the election results in Pennsylvania . The case went against Trump with the court denying a motion for a writ of certiorari (SCOTUS to review an Appeals Court decision ) Alito voted with the minority .

    20-542 Republican Party of Pennsylvania v. Degraffenreid (02/22/2021) (supremecourt.gov)

The upside-down flag was aloft on Jan. 17, 2021, the images showed. President Donald J. Trump’s supporters, including some brandishing the same symbol, had rioted at the Capitol a little over a week before. Mr. Biden’s inauguration was three days away. Alarmed neighbors snapped photographs, some of which were recently obtained by The New York Times. Word of the flag filtered back to the court, people who worked there said in interviews.
While the flag was up, the court was still contending with whether to hear a 2020 election case, with Justice Alito on the losing end of that decision. In coming weeks, the justices will rule on two climactic cases involving the storming of the Capitol on Jan. 6, including whether Mr. Trump has immunity for his actions. Their decisions will shape how accountable he can be held for trying to overturn the last presidential election and his chances for re-election in the upcoming one.

Alito spoke on the matter to FOX News Sunday anchor Shannon Bream . He says his wife did it after a neighbor put up a F**K Trump banner up.

Justice Alito says he and his wife were walking in the neighborhood and there were words between Mrs. Alito and a male at the home with the sign. Alito says the man engaged in vulgar language, "including the c-word".

Following that exchange, Mrs. Alito was distraught and hung the flag upside down "for a short time". Justice Alito says some neighbors on his street are "very political" and acknowledges it was a very heated time in January
    (1) Shannon Bream on X: "I spoke directly with Justice #Alito about the flag story in the NYT. In addition to what's in the story, he told me a neighbor on their street had a "F--- Trump" sign that was within 50 feet of where children await the school bus in Jan 21. Mrs. Alito brought this up with the" / X

The Dems are afraid of a SCOTUS decision that will give Trump any form of immunity . The conservatives are probably divided on the issue. But Alito and Thomas are most likely to agree with Trump.

Thomas is already under attack because his wife Ginni backed Trump's efforts to change the results of the election.

The recusal card is becoming quite popular with the Dems . They are calling for Judge Cannon to recuse herself from the Trump document trial

But don't ask a judge who has REAL conflicts on interest ;like Judge Merchan in NYC for him to recuse himself.

So which justice should've recused themselves ?

Alito because his wife flew that flag upside down (normally a distress signal) ?

Or justice Ruth Bader Ginsberg who decided many Trump era cases but said in 2016 ;before the 2016 election

“I can’t imagine what this place would be — I can’t imagine what the country would be — with Donald Trump as our president,” she said. “For the country, it could be four years. For the court, it could be — I don’t even want to contemplate that.”
It reminded her of something her husband, Martin D. Ginsburg, a prominent tax lawyer who died in 2010, would have said.
“‘Now it’s time for us to move to New Zealand,’” Justice Ginsburg said, smiling ruefully.

Seems one flag controversy is not enough . The Slimes reports that another "provocative " flag was flown at the Alito residence

Supreme Court Justice Alito’s Beach House Displayed ‘Appeal to Heaven’ Flag - The New York Times (nytimes.com)

Ahh the controversial hate filled appeal to heaven .
The left claims this flag was OMG flown by some of the demonstrators on Jan 6 and somehow it means that the person with the flag is a Christian Nationalist .

It is a white flag with a pine tree with text " Appeal to Heaven" Controversial right ?

    Some brief history.

The pine tree at the time of the Revolution represented the New England states .(they adopted it from the Iroquois nation) Appeal to heaven was in John Locke's 'Second Treatise on Government ' . It was in the part of the book dealing with the right to revolution

When the people come into conflict with some part of their government, no judge presides. Instead, the people can and must invoke "that ultimate determination to themselves which belongs to all mankind . . . whether they have just cause to make their appeal to heaven" and act against the executive in these cases.

Locke's Second Treatise on Civil Government Chapters 14 & 15 Summary & Analysis | SparkNotes

To Locke ;when people face injustice and have no one on Earth to defend them, they must rely on a higher power and if necessary fight for justice. Locke saw this as the only way to protect people's rights when laws and governments fail.

The flag was used by a squadron of schooners (sail boats) in the war effort .

Designed by Colonel Joseph Reed, the flag later became the official flag of the Massachusetts navy .

Today such notions as defending your rights against the government makes you an insurrectionist .

You see ;any display of an American flag be it this Appeal to Heaven ;or Betsy Ross 's flag or the Gadsen flag is a symbol of extremism. But to the left in this country it is perfectly acceptable to fly Hamas flags
