Hello ,

I would be very thankful if someone could answer this question .

I am an Indian and I got married to a H1B visa holder of USA .I never travelled to US due to some differences and now I would like to get divorced from him .

What is the process so that I can cancel my H4 visa .

Please let me know .

Thanks in advance,
Punam.

Somehow I got this question from the Help Desk. That's unusual. In fact it never happened before. And peculiar, since I am not an immigration specialist.

Anyway, I imagine you can get the visa cancelled simply by making a request to BCIS. By why would you need to get it cancelled? Just don't use it.

Once you are legally divorced, your visa will be automatically terminated. No need to do anything...

Thank you ..

Though the visa gets terminated once I take divorce legally the stamping will be existing in my passport right ?

So I want that to be removed .Any option for this ?

Thanks ,
Punam.

I know next to nothing about Indian law and therefor hesitate to even guess. But it's very unlikely that you would have to wait until it expired to renew it. Therefore I am guessing that there is some "window of opportunity" in which to renew before it expires. I have no idea what the size of that window might be.

I suggest that you inquire of the passport issuing agency. You might also ask what the procedure is if you were to "loose" the passport.
