    Owners' holding mortgage
    Can I get the 1st time homeowners tax credit if I buy a home and the owner holds the mortgage?

    Yes - the mortgage has nothing to do with it. For example you could buy the house with cash - and have no mortgage at all - and still qualify for the credit.
